LulaRoost Driver Agreement

About this agreement

This agreement is between LulaLou's Ltd Liability Co., an Alabama limited liability company doing business as LulaRoost ("LulaRoost," "we," "us"), and the person who accepts it in the LulaRoost driver app ("you").

  • It takes effect when you tap "I agree" in the app. Your tap is your electronic signature.

  • What it includes. Schedule A (Fare and Pay Addendum) and Schedule B (Alabama Insurance Notice) are part of this agreement. So are the Driver Requirements and the policies named here, as posted in the app and at lularoost.com/driver-agreement.

  • Plain language. Headings are for convenience only. "Ride" means a prearranged ride booked through the LulaRoost app, as defined in Alabama PSC Rule 770-X-12-.02.

  • Questions. Contact support@lulalous.com.

1. Our relationship

  1. You run your own business. You are an independent contractor, not an employee, partner, joint venturer, or agent of LulaRoost. You can't make promises on LulaRoost's behalf.

  2. You decide when and whether to drive. You choose when to log in, and whether to accept, decline, or ignore any ride request. There is no minimum number of rides or hours, and you're free to drive for other companies too.

  3. What LulaRoost controls. LulaRoost does not control, direct, or manage you or your vehicle. The exceptions are the safety, legal, and quality rules written in this agreement, which Alabama allows by written contract (PSC Rule 770-X-12-.02(6)).

  4. What LulaRoost provides. We give you access to the LulaRoost app, which connects you with riders and collects payment for your rides.

2. Who can drive

To use the LulaRoost app as a driver, you must meet every one of these requirements, and keep meeting them:

  1. Be 25 or older.

  2. Hold a valid driver's license with at least 5 years of licensed driving experience.

  3. Meet the driving-record and criminal-history standards in Section 3 and in the Driver Requirements.

  4. Use a vehicle that meets Section 4.

  5. Have your driver's license (front and back), insurance card, and vehicle registration approved by LulaRoost.

  6. Upload a clear photo of yourself: you alone, facing the camera, full face and shoulders, with no sunglasses or filters.

  7. Complete Stripe's account setup so you can be paid.

You confirm that everything you provide to us is true and complete, and that you'll update it within 1 day if it changes. You may have only one driver account, and you may not let anyone else use it.

3. Background checks and driving records

  1. Before your first ride. You authorize LulaRoost to order, through Checkr, Inc. or another background-check company, all three checks Alabama requires (Code of Alabama §32-7C-29):

    • a multistate criminal records search

    • a National Sex Offender Public Website search

    • your driving record

  2. Separate disclosure. You'll receive and sign a separate background-check disclosure and authorization form, as required by federal law.

  3. Ongoing checks. We'll re-check you at least once a year, and may enroll you in continuous monitoring of your criminal and driving records.

  4. What disqualifies you. You can't drive if your records show any of the following:

    • more than 3 moving violations in the past 3 years

    • in the past 3 years, any eluding police, reckless driving, or driving on a suspended or revoked license

    • in the past 7 years, a felony, DUI, reckless driving, hit-and-run, violent misdemeanor, or sexual battery conviction

    • a listing on the sex offender registry

  5. Sharing results. You authorize LulaRoost to share your check results with our insurers and with the Alabama Public Service Commission when needed for insurance, safety, or legal compliance.

  6. If a report affects you. Before acting on a background report, we'll follow the notice steps required by federal law, and you'll have a chance to dispute the report.

4. Your vehicle

  1. Requirements. Your vehicle must be model year 2016 or newer and never more than 15 years old. It must be registered, insured with full coverage, in your lawful possession, and safe to drive.

  2. Inspections. An ASE- or AATI-certified mechanic must inspect it using LulaRoost Form LR-VSI-1 (PSC Rule 770-X-12-.07):

    • before your first ride

    • every year after that, for every vehicle (none are exempt)

  3. Recalls and repairs. You'll promptly address manufacturer recalls and keep the vehicle in good repair.

  4. The LulaRoost decal. Display the LulaRoost decal on your vehicle whenever you're logged in to the app, as required by Alabama (PSC Rule 770-X-12-.08). Remove it when you stop driving with LulaRoost.

5. Giving rides

  1. App rides only. You'll carry riders for pay only when the ride is booked through the LulaRoost app. Accepting street hails or cash rides is a crime in Alabama (Code of Alabama §32-7C-31) and terminates this agreement.

  2. Confirm the rider. Check the rider's name and photo before they get in. On Health rides, enter the last 4 digits of the rider's phone number. If the rider can't give them, you may skip that step only after the rider approves; the app records the skip.

  3. Arriving. Tap "Arrived" only when you're at the pickup spot; the app checks your location. For a Scheduled ride, the app accepts "Arrived" no earlier than the pickup time.

    • No-shows: if the rider hasn't come out after 7 minutes, you may cancel as a no-show.

    • Waiting longer: wait time after 7 minutes is charged as described in Schedule A.

  4. The route. The app will choose a safe, efficient route. Take riders directly to their destination, with no stops they didn't ask for.

  5. Equal service. You won't refuse or discriminate against any rider on any basis protected by law, including disability (Code of Alabama §32-7C-32).

    • Always accept service animals and mobility devices such as folding wheelchairs and walkers. Allergies and religious objections are not exceptions.

    • Never ask a rider about a disability.

  6. Zero tolerance for alcohol and drugs. You won't drive while impaired by any amount of alcohol or drugs (Code of Alabama §32-7C-30). A rider report of impairment suspends your account right away, for as long as the investigation lasts.

  7. Driving hours. After 11 hours of driving, you must take a 6-hour break. The app enforces this, and it is stricter than Alabama's 14-hour limit (PSC Rule 770-X-12-.12).

  8. Riders under 18. Riders under 18 may ride only with an adult account holder in the car. You may cancel without penalty if an unaccompanied minor is at the pickup. Once LulaRoost offers teen accounts, teen rides go only to drivers who choose to take them and meet the Teen Account Terms at lularoost.com/teen-terms.

  9. Seatbelts and car seats. Carry no more riders than you have seatbelts, and ask everyone to buckle up. You may cancel without penalty if a child doesn't have the car seat Alabama law requires.

  10. Riders, not packages. Don't accept a ride that's only to deliver an item, with no rider aboard.

  11. Payment in the app only. Don't ask for cash fares or take payment with a card reader or any other way outside the app. Cash tips are fine.

  12. Long-distance rides. Rides over 30 miles are offered only to drivers who opt in. You'll see the full pay before you accept.

6. Safety and incidents

  1. Emergencies. Call 911 first in any emergency.

  2. Report crashes and incidents within 24 hours. Report any crash, injury, property damage, threat, or rider complaint during a ride through the app or to safety@lulalous.com. Cooperate with LulaRoost's and our insurers' investigations.

  3. Report arrests and charges within 24 hours. Please tell us if you have been arrested for, charged with, or convicted of any crime, so we can review whether you can continue driving.

  4. Carry proof of insurance. Keep proof of insurance with you whenever you're logged in. After an accident, show it and say whether you were logged in or on a ride, as Alabama law requires (Code of Alabama §32-7C-2).

  5. Show the waybill. If a police officer or airport official asks, show the in-app waybill.

  6. Location sharing. The app shares your location with riders and LulaRoost while you're logged in and during rides, for safety and dispatch. You won't falsify your location. LulaRoost won't use it to direct how you work.

  7. No weapons. No weapons are allowed on a LulaRoost ride, for anyone. You may not carry a firearm or any other weapon while you're logged in or giving a ride, even where Alabama law allows carrying, and riders may not either. You may decline or end a ride if a rider has a weapon. Report it in the app or to safety@lulalous.com.

7. Rider information

  1. Use it only for the ride. You may use a rider's name, phone number, pickup, and drop-off only to complete that ride.

  2. No contact afterward. Don't contact a rider after the ride, keep their information, or share it with anyone, unless the rider agrees or the law requires it.

  3. Health rides. You'll see only what the ride needs: first name, pickup and drop-off, times, and any equipment the booker listed. Treat it as strictly confidential.

  4. Recording. You may record rides only with a mounted dash camera, and only while the LulaRoost recording notice is displayed where riders can see it before they get in. Share recordings only with LulaRoost, our insurers, the police or a court, and never post them online.

8. Insurance

  1. What LulaRoost carries. LulaRoost will keep the insurance Alabama requires for every ride (Code of Alabama §32-7C-2). Schedule B lists each coverage and its limits:

    • Primary coverage while you're logged in and waiting

    • $1,000,000 from the moment you accept a ride until the rider leaves your vehicle

LulaRoost won't reduce this coverage below Alabama's requirements. It will give you at least 30 days' notice in the app before changing the coverage described in Schedule B.

  1. What you carry. You'll keep your own full coverage auto insurance policy that meets Alabama's minimums whenever you drive, with yourself listed as an insured driver.

    • Upload proof at signup and at every renewal.

    • Tell LulaRoost within 24 hours if your policy is canceled or lapses. If it lapses, you may not drive.

  2. Your personal policy may not cover rideshare driving. Some insurers now offer rideshare coverage. If you decline your insurer's rideshare coverage, you must tell LulaRoost. Read the notice in Schedule B and check with your own insurer.

  3. Injury coverage for you. You're a contractor, not an employee, so workers' compensation doesn't cover you. We encourage you to carry occupational accident insurance.

9. Pay

Schedule A sets out how fares are calculated and how you're paid. In short:

  • You keep 70% of every fare after the fees listed in Schedule A are deducted.

  • You keep 100% of tips.

  • You're paid after every completed ride.

LulaRoost acts as your limited agent to collect payment from riders and pay you through Stripe.

10. Ratings

  1. How ratings work. After each ride, riders may rate you, and you may rate riders.

  2. Retraining. If your average falls below 4.6 stars, you'll complete a short retraining module before going back online.

  3. Ratings alone never end this agreement. A low rating can't cause a permanent deactivation without the review described in Section 11.

  4. Fairness. Ratings that are clearly retaliatory or discriminatory will be removed.

11. Deactivation and appeals

  1. Temporary suspension. LulaRoost may suspend your account while it investigates a serious report, such as:

    • impairment (always immediate)

    • a safety incident

    • a crash

    • fraud

    • discrimination, including refusing a service animal

    • a failed or expired background check, license, registration, insurance, or inspection

We'll explain the reason in the app when we suspend you, and we aim to complete the investigation within 14 business days.

  1. Permanent deactivation. LulaRoost may end your access for a serious or repeated violation of this agreement or the law. Examples:

    • impaired driving

    • violence or threats

    • sexual misconduct

    • fraud, including fake rides or location spoofing

    • refusing a service animal

    • accepting street hails

    • failing the standards in Section 3

  2. Human review and a written reason. No permanent deactivation happens automatically. A LulaRoost staff member reviews the facts first, and you get the reason in writing.

  3. Appeal. You may appeal in the app or at safety@lulalous.com within 30 days.

    • A different staff member decides the appeal within 14 business days.

    • You may send any information you want considered.

    • If the decision is reversed, you're reinstated, and any pay withheld because of the suspension is released.

  4. Pay you've earned. Pay for completed rides is never withheld because you're deactivated, except as Schedule A allows for fraud or chargebacks you caused.

12. Ending the agreement

  1. You may end this agreement at any time by deleting your driver account or telling us in writing.

  2. LulaRoost may end it with 7 days' notice for any reason, or right away under Section 11.

  3. What survives. Sections 7, 9, 11.5, 13, 14, 15 and 16 and Schedule A survive the end of this agreement. Pay you've earned is still paid on schedule.

13. Taxes

  1. Your taxes are yours. You're responsible for your own taxes. LulaRoost doesn't withhold taxes from your pay.

  2. Tax forms. LulaRoost will collect your tax information through Stripe and send you an IRS Form 1099 when your yearly earnings reach the federal reporting threshold, currently $2,000.

  3. State fee. LulaRoost collects and pays Alabama's 1% TNC fee on fares; you don't.

14. Responsibility for losses

  1. Each side covers its own fault. You'll cover LulaRoost for losses caused by your negligence or your breach of this agreement, and LulaRoost will cover you for losses caused by its negligence or its breach.

  2. App problems. To the extent the law allows, LulaRoost isn't liable to you for losses caused by app outages, errors or delays.

  3. Required insurance stays in place. Nothing in this agreement reduces the insurance coverage Alabama requires (Code of Alabama §32-7C-2(j)).

15. Resolving disputes

  1. Talk to us first. Contact legal@lulalous.com and we'll try to resolve it within 30 days.

  2. Individual arbitration. If we can't resolve it, you and LulaRoost agree that any dispute will go to binding arbitration rather than court. That covers this agreement, your pay, deactivation, background checks, and whether you're an independent contractor. There is no judge or jury.

  3. How it works.

    • Rules. The American Arbitration Association handles the arbitration under its applicable rules.

    • Location. The hearing is in Houston County, Alabama, or by video.

    • Costs. LulaRoost pays all costs unique to arbitration. If you start the claim, you pay no more than a court filing fee would cost you.

    • Relief. The arbitrator can award the same individual relief a court could.

  4. No class actions. Claims may be brought only individually. They can't be brought as a class, collective, or representative action, in arbitration or in court.

  5. Exceptions. Either of us may:

    • bring an individual claim in small claims court

    • take a sexual assault or sexual harassment claim to court, as federal law allows

    • pursue workers' compensation or unemployment benefit claims through the usual state process

    • ask a court to stop misuse of LulaRoost's name, logo or app

Nothing here stops you from filing a charge with a government agency, such as the EEOC, the NLRB, or the Alabama PSC.

  1. Opting out. You can opt out of arbitration within 30 days of signing this agreement. Email legal@lulalous.com, with "Arbitration opt-out" in the subject line, and include your name, phone number, the email on your account, and a statement that you're opting out. LulaRoost won't retaliate against you for opting out, and the rest of this agreement still applies.

  2. If a claim isn't arbitrated. It goes, individually, to the state courts of Houston County, Alabama, or the federal court for the Middle District of Alabama.

  3. Governing law. The Federal Arbitration Act governs this section; if it doesn't apply, Alabama law does. Alabama law governs the rest of this agreement.

16. General terms

  1. Governing law. Alabama law governs this agreement.

  2. Changes. LulaRoost may update this agreement with at least 14 days' notice in the app. Pay changes require 30 days' notice. If you keep driving after the change takes effect, you accept it. If you don't agree, you may end the agreement.

  3. Notices. We send notices in the app and by email. You send yours to legal@lulalous.com or LulaLou's Ltd Liability Co., PO Box 65, Dothan, Alabama 36302.

  4. Assignment. LulaRoost may assign this agreement to a company that assumes control of the LulaRoost business. You may not assign it.

  5. Severability. If any part is unenforceable, the rest still applies.

  6. Entire agreement. This agreement, with its schedules and the policies it names, constitutes the entire agreement and supersedes any earlier one.

Schedule A: Fare and Pay Addendum

You keep 70% of every fare after the fees in A2 come off the top, plus 100% of your tips. You're paid after every completed ride, on every trip, whatever the distance.

A1. What riders pay

ChargeRate
Base fare$1.50
Per mile, first 30 miles$1.20
Per minute, first 30 miles$0.25
Per mile after 30 miles$1.25, with no per-minute charge
Minimum fare$6.50
Wait time$0.51 a minute, starting 7 minutes after your GPS-confirmed arrival, or after the pickup time if you arrive early for a Scheduled ride
Demand pricingNever more than 2 times the regular fare
Extra stops$2.00 each, up to 3
Luggage help, if the rider asks$2.00 light, $5.00 heavy
Booking fee$1.25 + $0.12 per mile
Alabama TNC fee1% of base + distance + time + demand pricing
Business and Health accountsPlus a 5% (Business) or $2.00 (Health) service fee

The fare is everything above except the booking fee, the Alabama TNC fee, and the Business or Health service fee. LulaRoost publishes these rates at lularoost.com/ride-terms and gives you 30 days' notice before changing them.

A2. What comes off the top

These come off the rider's total, before tip, before the split:

  1. The booking fee. LulaRoost uses it to pay for the insurance in Schedule B.

  2. The Alabama TNC fee. LulaRoost pays it to the PSC each quarter.

  3. The card-processing fee charged by Stripe for that payment.

  4. The Business or Health service fee, if applicable.

A3. Your share

You receive 70% of what's left, and LulaRoost keeps 30%. The same split applies on every ride, at any distance.

Example: 4 miles, 12 minutesAmount
Rider pays (before tip)$11.12
Less booking fee−$1.73
Less Alabama TNC fee−$0.09
Less card processing−$0.62
What's left$8.68
Your 70%$6.08
LulaRoost's 30%$2.60

A4. Tips

Tips are 100% yours. They're charged to the rider's card and sent to you as a separate transfer as soon as the charge succeeds. LulaRoost never takes any part of a tip.

A5. Promotions and credits

Rider promo codes and credits never reduce your pay. Your share is figured on the fare before any discount, and LulaRoost pays the discount. Driver referral bonuses follow the Referral and Promotion Terms at lularoost.com/promo-terms.

A6. Cancellations and no-shows

  1. Rider cancellations. A rider who cancels after the free 120 seconds, once you're on the way, pays a $5.00 cancellation fee. You get 70% ($3.50) and LulaRoost keeps 30%. If you hadn't started driving toward the pickup, the whole fee goes to LulaRoost. For a Scheduled ride, the rider can cancel at no charge until 1 hour before pickup.

  2. No-shows. A rider who doesn't come out within 7 minutes of your GPS-confirmed arrival (or of the pickup time, if you arrive early for a Scheduled ride) pays a no-show fee equal to the full estimated fare, plus any wait time after the 7 minutes. You get 30% of the no-show fee, and never less than $3.75; LulaRoost keeps the rest. Wait time is shared as in A3.

  3. Your share. These shares come straight off the fees. The Schedule A2 deductions don't apply, and LulaRoost pays the card-processing fee.

Damage fee. If a rider damages or soils your car beyond normal use, report it in the app with photos within 24 hours of the ride. If LulaRoost approves your report, the rider is charged a damage fee of up to $250, based on the extent of the damage, and you receive 100% of it, with nothing taken off the top.

A7. Refunds

LulaRoost has a no-refunds policy. If LulaRoost ever refunds a rider for a billing error, LulaRoost covers it and your share stays yours. Health rides that list medical equipment carry no wait-time charge.

A8. When you're paid

  1. Per ride. After each completed ride, once the rider's payment succeeds, LulaRoost starts a transfer of your share to your Stripe account within a minute.

  2. To your bank. Money normally reaches your bank about 2 business days after the ride. A new Stripe account's first payout can take 7 to 14 days.

  3. Instant Cash-out. When it's offered, you can send your balance to an eligible debit card, usually within 30 minutes. You pay the instant-payout fee.

  4. LulaRoost Card (optional). When it's offered, you can choose to have your pay sent to a LulaRoost-branded debit card issued by a partner bank through Stripe, with each ride's pay available right after the ride. You never have to use the card; you can always be paid to your own bank account instead. The card has its own cardholder agreement and fee schedule from the issuing bank, which you'll see before you sign up.

  5. Statements. Every ride in your earnings screen shows the rider's payment, each deduction, your share, and your tip.

A9. Payment agent

You appoint LulaRoost as your limited agent to collect rider payments for your rides and pass your share to you. A rider's payment to LulaRoost counts as payment to you.

A10. Adjustments and errors

  1. Reasons we may adjust a ride's pay:

    • fraud

    • a ride that wasn't actually given

    • a chargeback you caused

    • an overpayment

We'll show the reason in your earnings screen.

  1. What we never deduct. LulaRoost doesn't charge you for marketing, promotions, the app, or the decal.

  2. Reporting errors. Report a pay error within 30 days, and we'll answer within 7 days.

  3. Rider disputes. If a rider disputes a charge, you keep your pay unless we find you participated in fraud.

Schedule B: Alabama Insurance Notice

Alabama's TNC law requires LulaRoost to tell you in writing, before you accept your first ride, what insurance covers you while you drive with LulaRoost. Read this notice before you go online for the first time.

B1. What LulaRoost's insurance covers

WhenCoverageLimits
Logged out of the appNone from LulaRoost. Your own policy applies.Your policy's limits
Logged in and waiting for a ride requestPrimary auto liability$50,000 per person and $100,000 per incident for bodily injury or death; $25,000 for property damage
From accepting a ride until the rider gets outPrimary auto liability$1,000,000 for bodily injury, death and property damage combined
Any timeDamage to your own carNone from LulaRoost. Your own policy's comprehensive and collision coverage, or a rideshare endorsement, applies.

B2. Policy details

  • Insurer and policy number: Shown on your digital insurance card in the app, under Driver > Insurance. You can see it before you go online for the first time.

  • Claims: Report from the app or email safety@lulalous.com

  • Proof of coverage: The app shows a digital insurance card under Driver > Insurance. Show it to police or to anyone in an accident with you when asked.

B3. Your own auto policy

Important: Your personal auto insurance policy may not cover you while you're logged in to the LulaRoost app or giving a ride, depending on its terms.

  1. Keep your own policy. You must keep personal auto insurance that meets Alabama's minimums at all times, as Section 8 explains.

  2. Tell your insurer. Tell your own insurer that you drive for a rideshare app. Some insurers offer a rideshare endorsement that fills gaps in coverage.

  3. Logged-out driving is yours to insure. LulaRoost's insurance doesn't cover any driving while you're logged out.

B4. If your car has a loan or lien

Important: If the vehicle that you plan to use to provide TNC services through LulaRoost has a lien against it, your use of the vehicle may violate the terms of your contract with the lienholder. You must notify the lienholder that you will be using the vehicle for transportation services (Code of Alabama §32-7C-4(m)).

Your lender may also require comprehensive and collision coverage on the car, and may buy it at your cost if you don't keep it (Code of Alabama §32-7C-4(k)).

B5. If you're in an accident

  1. Get safe. Call 911 if anyone is hurt, or if the law requires a police report.

  2. Report it in the app within 24 hours. Include photos, the other driver's information, and the police report number, if applicable.

  3. Share your coverage. Show your digital insurance card. Don't discuss who was at fault.

  4. We share ride times with insurers. As Alabama law requires, LulaRoost shares the times you logged in and out, and the ride's start and end times, with the insurers and the people involved in the claim.

B6. Changes to coverage

LulaRoost will give you at least 30 days' notice before reducing any coverage, and will update the in-app insurance card the same day a policy changes.

B7. Acknowledgment

I have read this notice. I understand what LulaRoost's insurance covers and when; that my own auto policy may not cover me while I'm logged in or giving rides; and that if my car has a lien, I must notify the lienholder that I'll be using it for transportation services.

Drivers accept this agreement in the LulaRoost app. LulaRoost keeps a record of each driver's acceptance, with the date and time, for at least 2 years.

This agreement is version 1, dated October 14, 2026. It takes effect for each driver when they accept it in the app.
